Terms of Service

These terms of service apply to the use of "rapidUtils" (hereafter referred to as "the Service"). Please read these terms carefully and agree to them before using the Service.

Article 1 (Application of Terms)

  1. These terms set forth the conditions under which users receive the services provided by the operator.
  2. In addition to these terms, the operator may establish individual agreements and other guidelines concerning the use of the Service. In such cases, these individual agreements and guidelines shall take precedence and form part of these terms.
  3. By using the Service, users are deemed to have agreed to these terms.
  4. If a user is a minor, they must obtain the consent of their parent or legal guardian to use the Service. The operator will assume that such consent has been obtained.

Article 2 (Intellectual Property Rights and Content)

All rights, including intellectual property rights in the materials comprising the Service, belong to the operator or third parties owning such rights. Users do not acquire any rights to the materials and must not infringe the rights related to the materials without permission. The license to use the Service under these terms does not imply a license to use the intellectual property rights of the operator or third parties.

Article 3 (Changes, Additions, or Suspension of Service)

The operator may change, add to, or suspend all or part of the Service without prior notice, and users agree to this in advance.

Article 4 (Personal Information)

The operator will handle personal information obtained through the use of the Service in accordance with its privacy policy.

Article 5 (Prohibited Actions)

  1. Users are prohibited from engaging in the following actions:
    • Acts that could hinder the operation of the Service or are likely to do so.
    • Acts that interfere with other users' use of the Service.
    • Acts that infringe the copyright or other rights related to the Service.
    • Acts that infringe the rights or interests (including rights to reputation, privacy, and copyright) of the operator, other users, or third parties.
    • Acts that violate public order, laws, or regulations, or are likely to do so.
    • Acts that violate these terms.
    • Any other acts deemed inappropriate by the operator in light of the purpose of the Service.
  2. If the operator determines that a user has engaged in the prohibited actions outlined above, it may suspend the user's access to all or part of the Service without prior notice, and the operator assumes no liability for any resulting damage or disadvantage to the user.

Article 6 (Exclusion of Antisocial Forces)

Users assure the operator that they are not part of, nor are they associated with, any antisocial forces.

Article 7 (Disclaimer)

  1. The operator is not liable for any damage or disadvantage incurred by users due to force majeure events such as natural disasters, war, acts of terrorism, riots, labor disputes, epidemics, legislative changes, or government intervention that may cause the Service to be suspended, interrupted, or delayed.
  2. The operator makes no warranties, either express or implied, concerning the usefulness, completeness, accuracy, timeliness, reliability, or fitness for a particular purpose of the information provided through the Service.
  3. The operator is not responsible for restoring data lost, damaged, or altered for any reason.

Article 8 (Confidentiality)

Users must not disclose or leak any information obtained or learned from the operator during the use of the Service to third parties or use it for purposes other than using the Service.

Article 9 (Disputes with Third Parties)

  1. Users must resolve any disputes arising in connection with the Service with third parties at their own expense and responsibility.
  2. If the operator incurs damages (including legal fees) due to such disputes, the user must compensate the operator for those damages.

Article 10 (Non-transferability of Rights and Obligations)

Users may not transfer, assign, create security interests in, or otherwise dispose of their contractual status or rights and obligations under these terms without prior written consent from the operator.

Article 11 (Severability)

If any provision of these terms is found to be invalid or unenforceable under applicable law, it shall not affect the validity of the remaining provisions.

Article 12 (Amendment of Terms)

The operator may amend these terms as necessary, in accordance with Article 548-4 of the Civil Code, and will appropriately announce the details and effective date of such amendments.

Article 13 (Language)

The terms and conditions are officially provided in Japanese. Even if the operator provides translations of these terms in other languages, users agree that the Japanese version shall always apply in regards to the legal relationship between the user and the operator.

Article 14 (Governing Law and Jurisdiction)

  1. These terms shall be governed by and construed in accordance with the laws of Japan.
  2. The operator and the user agree in advance that the Fukuoka District Court shall have exclusive jurisdiction over any disputes arising in connection with the Service.
